Rental Terms and Conditions

PAYMENT & PAYMENT METHODS:

We accept Cash, Credit/Debit Card, PayPal, Cash App, and Venmo for all deposits and account balance payments.

By placing an order for a dumpster rental with Smart Business Consulting LLC, BDA “Dumpster Rentals Hagerstown,” you confirm that you have read, understood, and agreed to the following terms and conditions applicable to your service type.

WEIGHT OVERAGES:

Any weight over the specified limits will incur an additional charge of $0.09 per pound. Prices may vary and are subject to change without notice. Please note, prices do not include fuel surcharges outside of Washington County, Maryland.

MATERIAL RESTRICTIONS:

If you are disposing of materials such as dirt, brick, concrete, asphalt, stone, slate, or gravel, a 7-yard dumpster is required. Our Red dumpsters are not to be used for heavy debris removal unless previously authorized by Dumpster Rentals Hagerstown.

DRIVEWAYS AND PARKING AREAS:

The customer guarantees that the access area is adequate to support the weight of all required equipment and vehicles. Smart Business Consulting LLC, BDA “Dumpster Rentals Hagerstown,” is not liable for any damage to pavements, subsurfaces, lawns, fences, or shrubbery due to the weight of the equipment. We do offer driveway protection using RolliSkate Pads at an additional cost.

WASTE MATERIALS:

The customer agrees that the materials placed in the dumpster are defined as “waste material” and contain no hazardous materials. Each dumpster rental includes one delivery, one pickup, and one disposal service.

 The following are the weight limits included with the price paid for each rental option:

– 14-yard dumpsters 24-Hour Rental up to 2,000 lbs.

– 14-yard dumpsters 4-Day Rental up to 2,000 lbs.

– 14-yard dumpsters 7-Day Rental up to 4,000 lbs.

– 16-yard dumpsters 24-Hour Rental up to 2,000 lbs.

– 16-yard dumpsters 4-Day Rental up to 2,000 lbs.

– 16-yard dumpsters 7-Day Rental up to 4,000 lbs.

– 20-yard dumpsters 24-Hour Rental up to 3,000 lbs.

– 20-yard dumpsters 4-Day Rental up to 4,000 lbs.

– 20-yard dumpsters 7-Day Rental up to 5,000 lbs.

– 24-yard dumpsters 24-Hour Rental up to 4,000 lbs.

– 24-yard dumpsters 4-Day Rental up to 5,000 lbs.

– 24-yard dumpsters 7-Day Rental up to 6,000 lbs.

– 7-yard dumpsters for Heavy Debris are billed at $.09 per pound.

Fuel/mileage charges apply for deliveries outside of Washington County, MD. Contact us for specific pricing. Overweight charges and other surcharges may apply for excessive top-offs or improper loading (e.g., loads exceeding the container’s fill line).

ADDITIONAL FEES

– Manipulation of loads: $50.00

– Same-day cancellation: $50.00

– Change of dumpster location after drop-off: $50.00

– Unserviceable conditions (e.g., blocked container or unsuitable drop-off/pick-up site): $50.00

– Extended rental beyond 24 hours: $19.99 per additional day (if rental extends beyond 3 days, cost will default to 4-Day rental).

– Extended rental beyond 4 days: $19.99 per additional day (if rental extends beyond 6 days, cost will default to 7-day rental).

– Extended rental beyond 7 days: $10.00 per additional day (maximum rental period is 30 days).

– Mattresses and spring boxes may be placed in the dumpster at an additional cost of $5 per item in Washington county, and $28 in Frederick County (this is a landfill fee).

– Flat screen TV’s may not be placed in a dumpster, but can be collected for $5 each, for proper recycling.

– Tires may be placed in the dumpster for recycling purposes up to a max of five, at an additional cost of $10 per tire. Tires must be left next to the dumpster. Do not place them inside the dumpster.

PROHIBITED MATERIALS

Flammable materials, freon items, wet paint, batteries, oils, and electronics may not be placed in the dumpster. Please contact your county’s landfill for instructions on how to dispose of these prohibited items.

LIABILITY FOR FINES AND DAMAGES:

The customer is responsible for paying any fines due to an overloaded container and for any damage caused to the dumpster during the rental period.

GOVERNING LAW

This agreement is governed by the laws of the State of Maryland. Any disputes will be resolved in the District or Circuit Courts of Washington County, Maryland. The customer consents to the jurisdiction of these courts and waives the right to a jury trial.

ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties and supersedes any previous agreements, written or oral.

SEVERABILITY

If any section of this agreement is found to be invalid or unenforceable, the remaining portions shall remain valid and enforceable.

PAYMENT AND BILLING

The customer agrees to cover all collection costs, including attorney fees of at least $750.00 or 15% of the outstanding balance, whichever is greater, along with court costs.

INDEMNIFICATION

The customer agrees to defend, indemnify, and hold harmless Smart Business Consulting LLC, BDA “Dumpster Rentals Hagerstown,” and its employees and agents from any claims, costs, damages, or losses arising from the performance of the services, except in cases of the company’s sole negligence.

Terms & Conditions – Loading Helper Service

Effective Date: 3/14/25

Dumpster Rentals Hagerstown offers an optional Loading Helper Service for an additional fee of $300, in addition to the price of dumpster rental. By purchasing this service, you agree to the following terms and conditions:

  1. Scope of Service

    • This service includes two (2) loading helpers who will assist in loading your rented dumpster.
    • Loading is provided up to the maximum fill capacity of the dumpster.
    • The service is limited to loading only and does not include sorting, organizing, or any other additional work.

  2. Service Limitations

    • Our loading helpers do not provide cleaning services, demolition, or any labor beyond placing items into the dumpster.
    • Hazardous materials, prohibited items, or any items not allowed under the dumpster rental terms cannot be loaded by our helpers.

  3. Customer Responsibilities

    • The customer must ensure clear and safe access to the loading area.
    • The customer is responsible for directing the helpers regarding what should be loaded into the dumpster.
    • If the dumpster reaches its maximum allowable fill, loading will stop even if additional items remain.

  4. Liability & Indemnification

    • Dumpster Rentals Hagerstown and its loading helpers are not responsible for any damage to property, items, or personal belongings during the loading process.
    • By purchasing this service, the customer agrees to indemnify and hold harmless Dumpster Rentals Hagerstown and its employees from any claims, damages, or liabilities arising from the loading process.

  5. Service Availability & Cancellations

    • The Loading Helper Service is subject to availability and must be scheduled in advance.
    • Cancellations require at least 24 hours’ notice to qualify for a refund.
    • No refunds will be provided once loading has commenced.
